Deer Ridge Litigation Fund

Do you, as an owner at Deer Ridge Mountain Resort, believe we are ALL entitled to have access and be able to copy the books and records of our Homeowner's Association?

So, do I.

But, apparently, Employee Joe Thomas and President Luther Parker and the Board disagree - and are doing all they can to block access, publication and candid discussion of the Asinine Assessment, special deals and favored treatment - at the expense of all Owners.

What ARE they so afraid of us finding out?

Maybe it has to do with the HUGE $10,000 overcharge for my HOA Fees, special assessments, water and cable TV bill - which, in my personal opinion, is due to fraudulent intent or at least gross negligence by the Deer Ridge Board of Directors and / or General Manager Joe Thomas. Please see the posts for details.

We have no choice but to file a lawsuit against GGRC and RML in order to finally, once and for all, make it clear that OWNERS do have a right to all the information about our property and our investment at Deer Ridge.

Gross Negligence – Or Is It Fraud?

Every Dollar You Pay For Deer Ridge Is The WRONG Amount!

Please read the various posts here on this Deer Ridge Owners Blog - and see my evidence and analysis which I believe shows conclusively that EVERY dollar of HOA Fees, EVERY dollar EVERY special assessment, EVERY water bill and cable TV sent out for YEARS to ALL Deer Ridge Owners has been wrong!

In many cases at least ONE THIRD of ALL owners have been GROSSLY overcharged. My calculations show that I have been overcharged more than TEN THOUSAND DOLLARS in the past 50 months I've owned at Deer Ridge.

The Board has been WRONGLY and arbitrarily ignoring the requirements of the Master Deed and the Bylaws for YEARS.

If my analysis is correct, the Board has zero choice. They MUST abide by the Master Deed Percentages.

But they haven’t.

However, if the Board knowingly ignored the clear directives of the Master Deed and the Bylaws when allocating costs to various unit types, and overcharging certain unit types on a regular basis, my opinion is that the Board and Joe Thomas may have acted fraudulently.

If they have not been fraudulent, then they have been, at the very least, grossly negligent.

Just did a quickie analysis on the $1,000 across the board assessment done by the Board a few years ago.

As you can see, the Board was either grossly negligent OR fraudulent in charging ALL owners the same amount for that assessment – instead of applying the REQUIRED Master Deed Percentages:

As you can see, I and 29 OTHER owners were charged almost DOUBLE what we should have been charged on this particular assessment – with clear disregard for the provisions of the Bylaws and Master Deed of Deer Ridge Mountain Resort.

36% of ALL Owners Overcharged a total of $14,628 – Just on this one item!

I don’t know about you – but I want my money back TODAY!  Along with interest at the highest legal limit,  at least treble damages, etc.

What else is going on at Deer Ridge that is so WRONG – that Joey and the Board are blocking access to books and records by all the owners?

How much more gross incompetence, gross negligence and / or fraud does the current Board of Directors need to see before firing, with cause, the General Manager of Deer Ridge, Joe Thomas?

PS:  The above “mistake” on the $1,000 per unit assessment from a few years ago is just a “taste test” of a much broader analysis and posting I am working on – if you liked the last major news on my blog, please stay tuned for another major news announcement in the next couple of days of even more, SIGNIFICANT, problems that are also, in my opinion, EITHER fraudulent behavior and / or gross negligence by Joe Thomas and / or the Board of Directors of Deer Ridge.

    I don’t know how i got on your ‘prestigious list’ but i am sure glad i did!
    And, thumbs up to all of you!

    I have a few questions and since all your email addresses were together, i thought i would just respond on your forward jim, since i am now included. Thank You!

    My first question is ….

    1. I am having a problem with mail sorting at the office here at Deer Ridge. This has been going on for a long time. Even you Joe, have opened up at least one of my Sevier Co Electric bills in error. I appreciate you writing the note on the top of the opened envelope. I understand how that can occur. Jamie and Wayne are very aware of this issue. Jamie found two for me last week, misfiled. One was important from my lawyer and another not, but i just want my mail. I try not to send my ‘important’ mail at this location, but even some of my bills sometime end up in other residents file box, opened or taped or i don’t get them at all. I was wondering whether we (residents) could acquire the mailboxes that are on the outside of the building, that way the office doesn’t have to be bothered and the mail carrier can sort it? They are not used for anything that i am aware of anyway. This would make it much easier for everyone. Shelly, E103 would also like a box if it were available. I am sure others would also. Please let me know and thank you in advance for timely response back.

    2. re: Master Deed/bylaws. IF in fact, there is a discrepancy of past due HOA’s and Assessments per Master Deed, do you have any idea how you plan on refunding the amount that is owed back to all the owners of the units? I know if in fact, that amount is correct then this will be a hefty sum of money x 1bdm units alone. Close to $10,000. on mine. I am still paying my HOA’s and have always paid them on time, as you are aware, but now wonder if you plan on rectifying this situation as timely as i have paid my HOA’s and assessments in the past, if indeed this is correct? I realize the only thing left IF it is correct with no response from board/Joe will be litigation/class action or small claims.

    3. Also, i ask that you please review the pet policy for residents.

    4. I hope we can be made aware of the $353. assessments for the next two years in detail. How the money will be handled (escrow?) and exactly how it will be spent? Every dollar. Who bids, who are the contractors? I also hope you reconsider opening up the books/computer to 84 owners. Seems only right.

    5. Digital voice recorder is such a wonderful idea brought about by Neil and Robert! What an asset they are for all owners! What a difference that would make for ALL owners to be able to hear what is going on. I know myself it is hard to get there when i work. Most owners are interested but are living way too far away. Lucky they get here a couple of times per year. That way we can all be informed.

    Please reconsider as this would end a lot of confusion and everyone would be informed as they should be. Less questions for you as board/committee members i would imagine as well. Good for All!

    The 84,000 was never explained what it was used for. Blocked answers and vague minutes. Seemed to me most of it went to the Pavillion.
