Deer Ridge Litigation Fund

Do you, as an owner at Deer Ridge Mountain Resort, believe we are ALL entitled to have access and be able to copy the books and records of our Homeowner's Association?

So, do I.

But, apparently, Employee Joe Thomas and President Luther Parker and the Board disagree - and are doing all they can to block access, publication and candid discussion of the Asinine Assessment, special deals and favored treatment - at the expense of all Owners.

What ARE they so afraid of us finding out?

Maybe it has to do with the HUGE $10,000 overcharge for my HOA Fees, special assessments, water and cable TV bill - which, in my personal opinion, is due to fraudulent intent or at least gross negligence by the Deer Ridge Board of Directors and / or General Manager Joe Thomas. Please see the posts for details.

We have no choice but to file a lawsuit against GGRC and RML in order to finally, once and for all, make it clear that OWNERS do have a right to all the information about our property and our investment at Deer Ridge.

Gross Negligence – Or Is It Fraud?

Every Dollar You Pay For Deer Ridge Is The WRONG Amount!

Please read the various posts here on this Deer Ridge Owners Blog - and see my evidence and analysis which I believe shows conclusively that EVERY dollar of HOA Fees, EVERY dollar EVERY special assessment, EVERY water bill and cable TV sent out for YEARS to ALL Deer Ridge Owners has been wrong!

In many cases at least ONE THIRD of ALL owners have been GROSSLY overcharged. My calculations show that I have been overcharged more than TEN THOUSAND DOLLARS in the past 50 months I've owned at Deer Ridge.

The Board has been WRONGLY and arbitrarily ignoring the requirements of the Master Deed and the Bylaws for YEARS.

If my analysis is correct, the Board has zero choice. They MUST abide by the Master Deed Percentages.

But they haven’t.

However, if the Board knowingly ignored the clear directives of the Master Deed and the Bylaws when allocating costs to various unit types, and overcharging certain unit types on a regular basis, my opinion is that the Board and Joe Thomas may have acted fraudulently.

If they have not been fraudulent, then they have been, at the very least, grossly negligent.

Why is the Board sooooo dead set against having audio recordings of all Board meetings made available to all owners to hear?

I personally have the Olympus DS-30 shown in the photo.  It does a GREAT job and is under $90 at Amazon.  With the way that the Board squanders money on RML, wouldn’t it be worth $90 total for all owners to be able to REALLY hear what happens at Board meetings – especially when they are spending YOUR money?

On top of that, Neil has offered to even buy the digital recorder…and I have offered to take the digital recordings and post them for zero cost on this site so ALL owners can play them online or download them and play them on their own computer, iPod or other MP3 players.  That way, EVERYONE could know everything that occurs during the meetings that affect OUR property and OUR personal investment.

So, what POSSIBLE excuse can the Board have for saying NO???

This is all that was reported during the last Board Meeting Minutes reported by Luther:

Digital Recording of Board Meetings. Larry Ohm and Marge Duncan both stated they felt the minutes of the Board meetings are being recorded well. The Board decided it is at its discretion as to how the minutes of the meetings are recorded. At this time the current methods of recording have been deemed sufficient.

Well, golly gee whiz, Larry and Marge – you all are THERE.  Most owners are not.  You would think anyone could understand that difference.

Likewise, I understand that the Board has gone on record that an Owner can’t even record any Board meeting using their own equipment.   Do any other Owners find this position as outrageous as I do?

The current haphazard, incomplete and I believe intentionally vague recap of the meeting shenanigans are NOT sufficient by a long shot – and the ONLY reason I can think of why soooooo much resistance to this ZERO cost issue is SECRECRY and SIDE DEALS and LIES to all the owners.  There simply can’t be any other reason NOT to provide this record to all owners.

Could it be that the Board knows if the meetings are recorded, then the subterfuge about the assessments are being partly done as  a way to cover “operating deficit” caused by the Board continuing to feed OUR cash into RML?

I suggest that Owners consider filing a lawsuit to force the Board to provide this record.

At our condo in Florida, not only do they digitally record the meetings – they just started doing a live webcam broadcast than ANY owner can watch from anywhere in the world.  Plus they are recorded, so, like You Tube, owners can watch the Board meeting videos anytime they want – as often as they want.

Isn’t it about time that Deer Ridge joined the new millennium for the benefit of ALL owners – and be COMPLETELY transparent?

    I feel there must be accountablity for anyone handling funding that is the owners $, whether those be in assessments or hoa fees. Every owner needs to have access to board meetings, either in person or on a format such as Neil and Robert have mentioned. To view if they wish for themselves. Thank you both for all the time/effort on this Robert & Neil.

    This is a way to keep everyone and i mean everyone, board members,manager and owners alike updated,understanding and accountable and would keep everything much more respectful. The boards job is not easy. In transition like we are in, there may be tense moments, but we can all agree to disagree and move forward for the best interest of All owners, in all applications. They (board) has accepted this endeavor as board members, challenges are occuring, they need to address them. Let’s unite and grow this together. With digital meeting recordings everything then is on top of the table for viewing and honesty will endure. It will also create less problems and more trust, making board members job a bit easier and cordial. I must ask myself, as i am sure you reading this is wondering… why would any board member in their right mind not want this? It is for everyone’s protection.

    As Jan mentioned ‘legal’ reasons. Thank you Jan. Understanably so; however, a fee is a fee is a fee. It is what it is! We just all need to be aware of where our funds are going and what they are actually funding. There is way too much money here at Asess x 84 = 353, to allow for open passage w/o accountability. How do we know where these funds are actually heading? If history repeats itself with old tactics, we still have open doors and windows. Could funds remain to be a fraction of a ‘float’ account to again bail out rml for the future? Ensuring rml preservation/salary’s. Could portions of this assessment end someone’s pocket? Digital recordings are protection and owner-fund preseravation. C’mon, let’s get it on board Luther! Keep all above board!

    On the Discussion of Digitally Recording the Meetings… The statement that Marge and Larry feel the minutes of the board are being recorded well, The excerpt above is the only mention of the subject…

    It does not say whether the board voted on this issue or not, it does not say there was any discussion by the other board members, it does not say if there was a vote who voted yea or nay…

    I have attended, listened to, asked a few questions, was asked for feed back on a few subjects, I have never caused any problems, was respectful, and have always been treated with respect from all board members in the meetings, BUT Because many of the other owners can not be present, they do not know exactly what has been discussed on any of the many subjects brought up at the meetings, and most may not want to hear every word, BUT for the ones that are interested, they should have a way to do that..

    I can say that in some discussions by the board, some of the board members have used flawed logic, have been told not to answer questions asked by another owner, move back and forth on RML business and G.G. & R.C. business, and only recently stopped making loans to RML.

    I have volunteered to donate up to 150.00 to get a good digital recorder and microphone, Robert has agreed to upload and / or convert to MP3 format, so that any and all that might want to hear exactly what is said, and how it is said in meetings, can do so.. from anywhere, at any time that is convenient to them

    I don’t think this is too much to ask, We as owners need to be fully informed on how ALL issues & expenses are handled,

    Apparently the board does not think we as owners need to know how they arrive at decisions $$$ that effect us all…

    Marge, Larry, Luther & Board, Please vote on this again..

    If recording is allowed, then “operating assesment” can not be changed to higher “Home Owners Fees” when the board is informed that “operating assesment” is not the legal way to handle this.
